You must legally own the week you are depositing.  All maintenance fees or similar charges must be current at the resort you are depositing.  The maximum time a deposit may be made is up to two (2) years prior to the week assignment where allowed by the home resort.  The minimum time a deposit may be made is 60 days prior to the assigned dates. Deposits received with less than 60 days notice of assignment dates are not guaranteed without prior approval, however Vacation and Travel will use their best efforts to deposit the week.  All deposit agreements are exclusive, you the owner will be charged the cost to re-accommodate any guest if the guest is denied use of your deposited week. Do not double bank the same unit in the same use year with another exchange company.  Do not place a deposited week for rent.  All deposits must be traveled against within two (2) years after the start date of the week assignment. If the deposited week is not traveled against within this time period, the week will expire. Expiring weeks may be extended for one year at an optional fee per week. Weeks must be extended prior to their expiration date and may be extended as many times as needed.  Vacation and Travel reserves the right to accept or deny any deposit.  All vacation exchanges are arranged on a space available basis, Vacation and Travel cannot guarantee fulfillment of a specific request. Accommodations into which you exchange may be different in size, amenities, furnishings and facilities than that which you gave up. Confirmations issued hereunder are valid only if issued by us. Upon receipt, please check all the details in the Confirmation and notify us immediately if anything is incorrect, as changes to any aspect of the Confirmation may be treated as a cancellation. Owners and guests are responsible for re-confirming their reservation directly with the Resort at least 48 hours in advance of their arrival. In the event you will be a checking in past the official check-in day or past normal check in hours, it is your responsibility to contact the exchange resort directly and advise them accordingly. The total number of people occupying any accommodation(s) must not exceed the maximum occupancy of the particular accommodation(s) set forth in the Confirmation; otherwise, access may be refused, or the applicable resort or provider of the accommodations may levy an additional charge. You are responsible for payment of any resort fees, applicable taxes, gratuities, personal expenses, utility charges, security deposits and other fees or charges levied by a resort and/or provider of accommodations for the use of amenities and facilities. You and your guests must occupy and use any accommodations in a responsible, careful and secure manner. You are responsible for any acts and omissions which result in any damage, theft or loss caused by you or your guests while using the accommodations. You must be at least twenty-one (21) years of age to confirm a vacation on this Website. In some instances, the minimum age to make a reservation may be higher where required by a resort or other provider of accommodations. Any complaints about the accommodations or services provided at a resort should be made at the earliest opportunity first to a person in authority at the resort and to Vacation and Travel. A Confirmation may not be used for any commercial purpose, including rental or sale of the accommodation(s) which is/are represented by such Confirmation. A Confirmation may only be used by the person whose name(s) appears on the Confirmation. We reserve the right to cancel your Confirmation if payment for any accommodation(s) is/are rejected by your bank or Credit Card Company. In the event that a resort or other accommodation becomes uninhabitable due to a natural disaster, we will not be liable for any resulting cancellations and no refund of any amounts paid by you will be made. Vacation and Travel is not liable for a replacement exchange reservation in event of such cancellation.  If the accommodations which you confirmed become unavailable due to natural disaster, act of God, civil unrest or any other reason beyond our control, you waive any and all claims against us. We will have no liability to you for any loss, injury or damage which may occur while you stay at resort or other accommodation confirmed by you through Vacation and Travel or as a result of any third party.  All fees after payment are final, and non-refundable for any reason. RENTAL and EXCHANGE reservation fees are non-refundable under any circumstances.  Name changes are allowed at no fee. Name changes must be submitted 5 businesses prior to check in date with Vacation and Travel in order for the new guest to receive a written confirmation to present at check in.  If a Guest seeks to cancel a confirmed EXCHANGE reservation more than 45 days prior to the arrival date, Guest must contact us first and then will be given a deposit credit by Vacation and Travel for an alternative reservation, provided Guest pay another transaction fee for any subsequently confirmed reservation. The credit must be used prior to the expiration of the original deposited week used for the exchange. Cancellation of a reservation less than 45 days prior to the arrival date, will result in Guests forfeiture of the original deposit used for the exchange unless the exchange reservation is utilized by another Vacation and Travel Guest. We highly recommend the purchase of Travel Insurance to cover any or all loses in the case of medical or natural disasters in regard to your reservation.  Guest may use any travel Insurance company of their choice.  Travel Insurance must be purchased and in place prior to the start date of your reservation to be valid for coverage. If guest has pre-existing medical conditions, please check specific coverage clauses first with the Insurance company. Our liability for any loss, injury or damage incurred by you as a result of any action or failure to act on our part, will be limited to consideration paid by you for the exchange or rental accommodation provided by or through Vacation and Travel, and in no event will we be liable for special, consequential or punitive damages. This limitation of liability shall also apply to all affiliated companies, servants and agents of Vacation and Travel. Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this Website, and you agree to abide by all other applicable terms and conditions including, but not limited to, paying all amounts owed on a timely basis and complying with all rules and restrictions regarding availability of products, programs or services. Information about resorts and other accommodations available hereunder is based on information obtained from such resorts and/or providers of such accommodations. We expressly disclaim liability for inaccurate, incomplete or misleading information concerning any resort or provider of accommodations. These Terms and Conditions constitute the entire agreement between you and us with respect to this Website and your use of this Website. As such, these Terms and Conditions (as modified by us, from time to time) will be deemed to supersede any prior or future communications, whether electronic, oral or written, between us. A printed version of these Terms and Conditions given in electronic form shall be admissible in judicial or administrative proceedings to the same extent, and subject to, the same conditions as other business documents and records originally generated and maintained in printed form. All accommodations confirmed are on an “As Is and with All Faults” basis. We hereby expressly disclaim all warranties relating to any accommodations purchased hereunder, express or implied, statutory or otherwise, including, without limitation, any and all warranties of merchantability or fitness for a particular purpose.

Vacation and Travel makes no representation that content in this Website is appropriate or available for use in other locations. These Terms shall be governed by, construed and enforced in accordance with the laws of the State of Idaho, as they are applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or Vacation and Travel brings to enforce these Terms, or in connection with any matters related to this Website, shall be brought only in either the state or Federal courts located in Idaho and you expressly consent to the jurisdiction of said courts. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforcement of any remaining provisions.

These Terms are for the benefit of Vacation and Travel Services, Inc. and its Providers, its and their officers, directors, employees, affiliates, agents, licensors, and suppliers. Each of these individuals or entities shall have the right to assert and enforce these Terms directly against you on its or their own behalf.

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Vacation and Travel urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations.
